Legal Information
Purpose
These Terms of Use (hereinafter the "Terms") set out the conditions governing access to and use of the Espace service operated by the Lychen association (hereinafter the "Service"). Espace is a platform connecting people who have a growing space (land, garden, cellar, etc.) with people who wish to grow food, as part of an approach to food autonomy and social connection. The Service consists of the presentation website, the application available at app.espace.lychen.org and the application programming interface (API) available at api.espace.lychen.org.
Acceptance of the Terms
Use of the Service implies the user's full and unreserved acceptance of these Terms. By accessing the Service, creating an account or using the API, the user acknowledges having read these Terms and agrees to comply with them. If the user does not accept these Terms, they must refrain from using the Service.
Access to the Service
Access to the Service is free. The application is available at app.espace.lychen.org and the API at api.espace.lychen.org. The costs of accessing and using the telecommunications network are borne by the user, according to the terms set by their internet service providers and telecommunications operators. The user acknowledges having the skills and means necessary to access and use the Service.
User Account
Use of the Service
The user agrees to use the Service fairly, in accordance with its purpose and with applicable laws and regulations. In particular, the user must not: publish unlawful, misleading, defamatory content or content that infringes the rights of third parties; impersonate a third party; disrupt, slow down or hinder the operation of the Service; attempt to gain unauthorized access to systems, accounts or data they are not entitled to; or use the Service for unauthorized commercial purposes or mass data collection.
Use of the API
The API available at api.espace.lychen.org is provided to enable programmatic interaction with the Service, primarily through the application at app.espace.lychen.org. Any access to the API must comply with these Terms as well as any usage limits (quotas, rate limiting) put in place to preserve the stability and security of the Service. The Lychen association reserves the right to suspend or restrict access to the API in the event of abusive, excessive use or use contrary to these Terms.
Service Availability
The Lychen association strives to keep the Service continuously accessible, without however being bound by an obligation of result. Access to the Service may be interrupted, in particular for maintenance, updates or in the event of force majeure, without this engaging the liability of the association. The Lychen association reserves the right to modify, change or suspend all or part of the Service.
Intellectual Property
The entire Service is subject to French and international legislation on copyright and intellectual property. All reproduction rights are reserved, including for downloadable documents and iconographic and photographic representations. The reproduction of all or part of the Service on any electronic medium whatsoever is strictly prohibited without the express authorization of the publication director. Content published by users remains their property; by publishing it, the user grants the Lychen association a license to use it for the purposes of operating the Service.
Liability
The information provided on the Service is for information purposes only. The Lychen association cannot guarantee the accuracy, completeness or timeliness of the information disseminated, in particular that published by users. The connection made through the Service is the sole responsibility of the users concerned. Consequently, the user acknowledges using the Service and the information it contains under their exclusive responsibility.
Personal Data
Changes to the Terms
The Lychen association reserves the right to modify these Terms at any time, in particular to adapt them to changes in the Service or in regulations. The applicable Terms are those in force at the date the Service is used. The date of the last update is indicated at the top of this page. In the event of a substantial change, users will be informed by appropriate means.
Governing Law
These Terms are governed by French law. In the event of a dispute relating to their interpretation or performance, and in the absence of an amicable resolution, the French courts shall have sole jurisdiction.
